Recommendation of the Board for Correction on xxxxx xxxxxx, Docket No.093-88

Xxxxxxx filed an application with the Board for Correction dated xxxxx x, 1988, in which he requested the Board for Correction to remove the following comment from his COER: "Officer has had serious interpersonal relationship problems--which would lower some ratings one level. " The merits of Xxxxxxx' s request we re reviewed on the basis of the documentation submitted. The relevant facts in the proceedings of the Board were included in Attachment 1 to this memorandum.

After consideration of all of the documentation submitted, the recommendation of the members of the Board for Correction was that Xxxxxxx's request be denied. Approval of this recommendation will require no change in Xxxxxxx's record.

I certify that this recommendation reflects the action taken by the members of the Board for Correction, as contained in Attachment 1, and that they have been reviewed and concurred with by the Board members. Further, I certify that the documentation contained includes all informatlon submitted to the members of the Board and that, in addition to applicable statutes, regulations and policies, it has been considered in arriving at this recommendation. Finally, I certify that a quorum of Board members was present on xxxxxx xx, 1988, when Xxxxxxx's request was considered.

BOARD ACTION ON THE REOUEST OF: xxxxxxxxxxxxxxx

I. FINDINGS AND CONCLUSIONS:

The members of the Board found that:

  1. Xxxxxxx and Xxxxxxx were in disagreement over the severity of his behavior resulting in complaints by employees and whether they related to his job performance.
  2. Xxxxxxx, Xxxxxxx's immediate supervisor and rating officer, gave him a satisfactory performance evaluation during the period when Xxxxxxx, the reviewing officer, received complaints regarding his behavior.
  3. Xxxxxxx had the opportunity to rebut the comment Xxxxxxx wrote on his COER regarding the complaints he received; Xxxxxxx did not do so. Xxxxxxx also had the opportunity to interview the complaining employees and obtain information to support his version of the facts. This information could have been used to document his grievance seeking removal of the comment from his COER.
  4. Xxxxxxx's grievance was considered at all levels of the agency's grievance process; it was denied at each level.

In Summary :

The members of the Board found no documentation in the record upon which to reverse the decisions of the grievance officers.

II. RECOMMENDATION:

After consideration of all of the documentation submitted, the recommendation of the members of the Board for Correction was that Xxxxxxx's request be denied. Approval of this recommendation will require no change in Xxxxxxx's record.
