109.00 Appointment as Commissioned Officer Change appointment dateRecommendation of the Board for Correction on the Request of Xxxxx x xxxxxx, xxxxx xxxxxxx, Docket No.100-88 Xxxxx Xxxxxxx xxxx.xx said she was asked by staff at Xxxxd xxxxxxxx, Washington, D.C. to work. as a COSTEP student, during the summer of xxx, 'at the xxxxxxx xxxxx xxxxxxx operated by the xxxx of xxx xxxxxx. xxxxx Xxxxd said she told a staff person in the Division of Commissioned Personnel (DCP), Office of the Surgeon General, as early as Mid-May xxxx that she would be available for an appointment xxxx, xxxx. As early as March xxxx staff of that Division had been in contact with her requesting documents incident to her appointment. Xxxxx Xxxxxxx Xxxxx reported to work on June 1, xxxx, on A month sooner than her orders were issued, thinking that processing of her paperwork had been completed. According to DCP, xxxxx Xxxxxx's application for a xxxx appointment was incomplete at the time she reported to work causing a delay in making her appointment and in issuing her orders. DCP indicated that in an effort to obtain the documents required, a telephone message had been left with a relative of xxxxx xxxxxx which was either not relayed to her or to which she chose not to respond. DCP placed xxxxx Xxxxd on the payroll as of xxxx, xxxx, when in their opinion processing of her paperwork had been completed. xxxxxxxxxxxxx Xxxxd filed an application with the Board for Correction, dated Xxxx, xxxx, in which she requested that her record be corrected to change her active duty date from Xxx X, xxxx, to June 1, xxxx, and that she be authorized pay and allowances for the period from June 1, xxxx, to Xxxx, xxxx. xxxxx Xxxxx contended that she was not responsible for the delay in making her appointment or in issuing her orders, and that she had been assured at the time she reported for work that processing of her paperwork had been completed. xxxxx xxxxxxx Xxxxx's request was sent to the Office of the Surgeon General for review and consideration. We were advised by that office that as a result of a ruling by the Office of the Comptroller General, the Corps did not have the authority to correct her record. However, the Office of the Surgeon General does not object to approving xxxxx Xxxxx's request. We did not believe that the facts and issues in xxxxx xxxxxxx Xxxxx's request justified processing it through the complete case development process, including a meeting of the Board. Also, we were interested in avoiding any further delay in processing her request. For these reasons, we sent copies of her Case File, that contained all of the information received, to the members of the Board and asked them to review the documentation and give us a recommendation on whether her request should be upheld or denied. The Board members reviewed the merits of xxxxx Xxxxx's request. After consideration of all of the documentation received, the recommendation of the members of the Board is that xxxxx xxxxxxx Xxxxx's request be upheld. Approval of her request will enable her to be paid, and receive allowances for the time she actually worked, but for which she had not been paid because she did not have her orders when she reported for work. Approval of her request also will require that her record be corrected to indicate that she came on active duty xxx x, xxxx, instead of Xxx x, xxxx.
